Holna Terms of Service

These terms cover your use of Holna, a wellness app for iPhone made by Obscurity Ltd. They are written to be plain and fair.

The short version

  • Holna is a wellness tool, not a medical device. It records and shows your own readings. It does not diagnose, score, predict, or give medical advice. Always speak to a clinician about your health.
  • Your data stays with you, on your own device, in an encrypted store. We do not collect or receive it.
  • Apple handles all payments through your Apple ID. You manage, cancel, and request refunds in your Apple ID settings.
  • The app is provided "as is". Nothing here limits the consumer rights you have under Irish or EU law.

These terms are an agreement between you and Obscurity Ltd, a private company limited by shares incorporated in Ireland (registered office: 71 Lower Baggot Street, Dublin 2, D02 P593, Ireland; CRO no. 622475), the maker of the Holna app ("Holna", "we", "us"). By downloading, installing, or using Holna, you agree to these terms. If you do not agree, please do not use the app.

1. Holna is a wellness tool, not a medical device

Please read this section carefully. It is the most important part of these terms.

  • Holna is a wellness and personal record-keeping app. It helps you measure, show, track, and export your own health readings, and prepare a summary to bring to a doctor's appointment.
  • Holna is not a medical device. It does not diagnose, assess risk, predict, score, classify, or interpret your health. It does not provide medical advice, diagnosis, or treatment, and it must not be used as a substitute for any of these.
  • Holna does not alert you to medical conditions or emergencies and must never be relied on to do so.
  • The readings, charts, summaries, and reports Holna produces are descriptive records of information you and your devices have provided. They are not a clinical assessment.
  • Always consult a qualified clinician about your health. Never disregard professional medical advice, or delay seeking it, because of something you saw in Holna. If you think you may have a medical emergency, contact your local emergency services immediately.

2. Your licence to use Holna

Subject to these terms, Obscurity Ltd grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Holna on Apple devices that you own or control, for your own personal, non-commercial use. This licence is governed by Apple's standard Licensed Application End User Licence Agreement (EULA), and by these terms where they add detail.

We retain all rights, title, and interest in Holna, including its name, design, and software. These terms do not grant you any rights in our intellectual property beyond the licence above.

3. Acceptable use

You agree not to:

  • copy, modify, distribute, sell, or lease any part of Holna;
  • reverse engineer, decompile, or attempt to extract the source code, except to the extent this restriction is prohibited by applicable law;
  • use Holna in any unlawful way, or to infringe anyone's rights;
  • interfere with, disrupt, or attempt to gain unauthorised access to the app or any device it runs on; or
  • use Holna in a way that could harm yourself or others, including by relying on it for clinical decisions (see Section 1).

4. Your data stays with you

Holna stores your health readings and logs only on your device, in an encrypted store. We do not collect or receive that data. You are responsible for your device, your passcode and biometrics, and for any data you choose to export and share through the iOS share sheet. Our Privacy Policy explains this in full.

5. Subscriptions and Apple billing

  • Holna offers a free tier and optional paid features ("Holna Plus"), available as a monthly or annual subscription, and a one-off "Founder Lifetime" option.
  • All purchases are processed by Apple through your Apple ID and the App Store. Obscurity Ltd does not handle or store your payment details.
  • Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
  • You manage, cancel, and request refunds for subscriptions through your Apple ID account settings, not through us. Refunds are handled by Apple under Apple's terms.
  • Any free trial converts to a paid subscription unless you cancel before it ends. Prices are as shown in the App Store and may vary by region.
  • If we change prices or what a plan includes, we will make reasonable efforts to tell you in advance. Changes do not affect a period you have already paid for.

6. Availability and changes

We may update, change, or discontinue Holna or any feature at any time. We aim to give reasonable notice of significant changes. We do not guarantee that the app will always be available, uninterrupted, or error-free.

7. Disclaimers

To the fullest extent permitted by law, Holna is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the readings, summaries, or reports produced by Holna are accurate, complete, or suitable for any particular purpose, including any clinical purpose.

Nothing in these terms excludes or limits any rights you have as a consumer that cannot be excluded or limited under Irish or EU law.

8. Limitation of liability

To the fullest extent permitted by law:

  • Obscurity Ltd is not liable for any indirect, incidental, special, or consequential loss, or for any loss of data, arising from your use of, or inability to use, Holna.
  • We are not liable for any decision you make about your health based on Holna. Holna is not a substitute for professional medical advice (see Section 1).
  • Where liability cannot lawfully be excluded, our total liability to you is limited to the amount you paid us for Holna in the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.

9. Termination

This licence continues until terminated. It ends automatically if you breach these terms. You can end it at any time by deleting the app. On termination you must stop using Holna; the data on your device is yours to keep or delete.

10. Apple's role

Apple is not a party to these terms and is not responsible for Holna or its content. Apple has no obligation to provide support or maintenance for Holna. Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a relevant US embargo and are not on any relevant restricted-parties list, as required by Apple's standard EULA.

11. Governing law

These terms are governed by the laws of Ireland. The courts of Ireland have non-exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections that apply where you live.
